Why Compliance Labeling Is Non-Negotiable
Cannabis, CBD, and nutraceutical products operate in some of the most heavily regulated spaces in consumer goods. A label that fails to meet state, federal, or industry requirements doesn't just look bad — it can result in product recalls, regulatory fines, retail delisting, or worse. Getting your compliance labeling right from the start protects your business and your customers.
Here's what you need to know about compliance labeling in these three categories.
Cannabis Labels: State-by-State Complexity
Cannabis labeling is regulated at the state level, and requirements vary significantly by jurisdiction. However, most state cannabis programs require some combination of the following on product labels:
- Product name and type (flower, concentrate, edible, tincture, etc.)
- Net weight or volume
- THC and CBD content (total and per serving)
- Serving size and servings per package
- Batch or lot number (for traceability)
- Harvest or production date
- Expiration or best-by date
- Licensed producer name and license number
- Universal symbol (required in most states — the cannabis leaf or exclamation mark in a triangle)
- Warning statements ("Keep out of reach of children," "For use only by adults 21+," etc.)
- Child-resistant packaging indicator
Important: Always verify your specific state's current requirements with a compliance attorney or your state's cannabis regulatory authority. Requirements change frequently.
CBD Labels: Federal and FTC Considerations
CBD products derived from hemp are federally legal under the 2018 Farm Bill, but the FDA has not yet established a formal regulatory framework for CBD in food and dietary supplements. This creates a complex labeling environment.
Current FDA guidance and FTC enforcement priorities mean CBD labels should:
- Not make disease claims ("treats anxiety," "cures pain") — these are drug claims and are prohibited
- Not make unsubstantiated health claims
- Accurately state CBD content per serving and per container
- Include a Supplement Facts panel if marketed as a dietary supplement
- Include a Nutrition Facts panel if marketed as a food or beverage
- List all ingredients
- Include net quantity of contents
- Include manufacturer name and address
Third-party lab testing (Certificate of Analysis) is not legally required on the label but is strongly recommended — and increasingly expected by retailers and consumers as a trust signal.
Nutraceutical Labels: FDA Dietary Supplement Requirements
Nutraceuticals marketed as dietary supplements are regulated by the FDA under DSHEA (Dietary Supplement Health and Education Act). Required label elements include:
- Statement of identity ("Dietary Supplement")
- Net quantity of contents
- Supplement Facts panel (serving size, servings per container, listed ingredients and amounts)
- Ingredient list (for ingredients not in the Supplement Facts panel)
- Name and place of business of manufacturer, packer, or distributor
- Directions for use
- Structure/function claims disclaimer if any claims are made: "This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease."
Label Design Considerations for Regulated Products
Beyond the required text, compliance labels in these categories need to balance regulatory requirements with brand presentation. Key design considerations:
- Legibility — Required text must meet minimum font size requirements (generally 1/16" for most FDA-regulated products)
- Contrast — Text must be clearly legible against the background
- Material durability — Labels on products stored in refrigerators, freezers, or humid environments need moisture-resistant substrates
- Tamper evidence — Many regulated products benefit from or require tamper-evident packaging
- Premium finish — Foil and specialty finishes can elevate brand perception while meeting all compliance requirements
